Velvet Spoon Terms and Conditions

1. Introduction
1.1. All clients attending dinners and events organised by Velvet Spoon and associated franchises should be aware that these functions are intended to introduce like-minded individuals without any pressure or obligation. Velvet Spoon does not guarantee that clients will meet a partner or a perfect match at these functions.

2. Eligibility and Fees
2.1. All new clients must be over the age of 18.
2.2. All fees are subject to change without notice.

3. Agency Policies
3.1. Name of Agency: Velvet Spoon
3.2. Business Type: Introduction Agency
3.3. Service Level: Each Member can expect to attend a minimum of 6 dinners or events over a 12-month regular membership period. Dinners and events listed on our website are classified as invitations.
3.4. Membership Fees:

• $99.00 for a one month ‘Taste Tester’, payable at registration, unless specified otherwise.
• $84.99/month for a three month membership.
• $74.99/month for a 6 month membership.
• A $29 booking fee is payable upon registration of each dinner or event. This fee will remain in a pending status until a seat is confirmed. If a seat cannot be confirmed, the booking fee will not be processed.

3.5. Criteria for Members:

1. Must be over 18 years of age.
2. Must be honest, ethical, and possess a friendly personality.

Any person supplying false or misleading information will not be registered and will have their membership cancelled.
3.6. Method of Introductions: Social dining or group events only. All personal information supplied remains confidential.
3.7. Membership Refund Policies: Full refund, less an admin fee of $29, if notified before 5:00 PM on the 3rd clear business day within the cooling-off period. This is a legal contract.
3.8. No refund after the cooling-off period.
3.9. Agent’s Complaint Procedure: All complaints must be received in writing and emailed to [email protected].
3.10. Client Obligations: As per the Member’s Guide, a download link is supplied upon registration.
3.11. False Information: Providing false information will exclude or terminate clients from Velvet Spoon.

5. Terms of Agreement
5.1. Memberships start from the date of payment unless otherwise stated.
5.2. Renewal of a membership is via application only.
5.3. From time to time, you may dine with someone you have met at a previous dinner.

6. Identity and Verification
6.1. We conduct ID verification checks through Stripe, a secure and trusted platform, to ensure the authenticity of our members. This process is implemented to maintain a secure and trustworthy community, ensuring your safety and peace of mind. For more information, please refer to Stripe’s Privacy Policy

7. Change of Details
7.1. You must notify us of any changes to your personal details, including changes to your email address, postal address, and contact telephone numbers. If you wish your details to be removed from our files, please request so in writing at [email protected], and Velvet Spoon will follow your instructions within 2 business days.

8. Allergies
8.1. If you have any allergies, it is your responsibility to notify the restaurant prior to dining. Velvet Spoon or its agencies will not take responsibility for any food allergies or health condition problems arising from the consumption of food or drinks at dinners and events.

9. Marital Status
9.1. This service is for singles not in another committed relationship unless stated otherwise.

10. Liability
10.1. To the maximum extent permitted by law, Velvet Spoon and its franchisees, subsidiaries, affiliates, and employees exclude any and all liability for any direct, indirect, special, incidental, or consequential damages or injuries arising out of or in any way connected with the attendance of any dinner or other event organised by Velvet Spoon. By agreeing to attend events sponsored by Velvet Spoon, Members waive any and all claims they or their heirs may have against Velvet Spoon, its franchisees, subsidiaries, affiliates, and employees.

11.1. We respect each site visitor’s right to personal privacy. We collect and use information throughout our website only as disclosed in this Privacy Policy. This statement applies solely to information collected on this website.

Contact Information: Collected for advising clients of upcoming dinners and events, and for special offers.

Profile Information: Collected for the purposes of providing suitable dinners and functions.

Profile information is used to place you at dinners and events with the most compatible companions and preferred venues.

16. Product and Services Terms and Conditions
16.1. The Customer: means you, the customer, who buys the services from Velvet Spoon.
16.2. Our and We: means Velvet Spoon (or in the case of franchisees, a franchisee of Velvet Spoon).
16.3. The Products: means the products supplied by Velvet Spoon to the Customer.
16.4. The Services: means the services supplied by Velvet Spoon to the Customer.
16.5. The Website: means the website www.velvetspoon.com.au.

17. Order and Acceptance
17.1. These Conditions shall apply to all orders and contracts for the supply of the Products and services by Velvet Spoon to the Customer. All orders for the Products and Services shall be deemed to be an offer by the Customer to purchase the Products and Services in accordance with these Conditions. Any variations to these Conditions must be in writing.
17.2. The acceptance of orders for the Products and Services shall be at the entire discretion of Velvet Spoon. Our acceptance of an order occurs when a Contract is signed by both parties.
17.3. You may not obtain any services on our website if you are under 18 years of age.

18. Prices and Payment
18.1. Unless otherwise stated in writing, the prices quoted by Velvet Spoon on the website are inclusive of GST and any other applicable taxes.
18.2. The price of the other services will be as quoted on application.
18.3. You can pay by any of the methods listed in our relevant emails. Please ensure that if you are paying by credit card or debit card, you provide accurate details.
18.4. When you input your postcode into the website, you are automatically directed to the website referring to your local Velvet Spoon representative. We reserve the right to make promotional offers with different fees and features.

19. Oral Statements
19.1. The Customer agrees that, in the event of any conflict, written information about the Products and Services supplied by Velvet Spoon shall prevail over any oral statements made by Velvet Spoon or by Velvet Spoon’s employees or agents or franchisees. Velvet Spoon shall use all reasonable efforts to ensure that its written information about the Products and Services is accurate.

20. Governing Law
20.1. These terms and conditions are governed by the laws of Australia, and you agree that the Australian courts shall have exclusive jurisdiction in any dispute. This site is for use only by persons who access it from within Australia. Goods and services available from this site are available only to residents of (or companies incorporated in) Australia.
